Discreta Terms of Service

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Discreta, governing your access to and use of the Discreta mobile application, website, wearable device, and related services (collectively, the "Service").

By creating an account, downloading the app, or using the Discreta device, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.

The subscriber must be at least 18 years old to enter into this agreement. A subscriber may set up and provide the Service to a minor in their care (such as a dependent or employee under 18), provided the subscriber accepts full responsibility for that person's use of the Service.

2. Description of the Service

Discreta is a personal safety system consisting of:

• A wearable hardware button ("Device") that triggers silent SOS alerts
• A mobile application ("App") that pairs with the Device, manages emergency contacts, and transmits your real-time location
• A session timer feature that automatically alerts your contacts if you fail to check in
• SMS notifications delivered to up to 5 emergency contacts via third-party SMS infrastructure

Discreta is designed as a supplemental safety aid. It is not a substitute for emergency services. In any life-threatening situation, always contact emergency services (911 or local equivalent) first.

3. Account Registration & Security

To use Discreta, you must sign in using a valid Google (Gmail) or Apple account. By doing so, you authorize us to receive basic profile information from those providers as described in our Privacy Policy.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring your emergency contacts have consented to receive SMS alerts from Discreta on your behalf

You must notify us immediately at 514-830-5176 if you suspect unauthorized access to your account.

You agree to use Discreta solely for lawful personal safety purposes. You must not:

• Use the Service to harass, stalk, or monitor any person without their knowledge or consent
• Trigger false or test SOS alerts that could alarm emergency contacts without cause
• Attempt to reverse-engineer, modify, or tamper with the Device or App
• Use the Service in any way that violates applicable laws in Canada, the United States, or your jurisdiction
• Share your account credentials with unauthorized users
• Resell, sublicense, or commercially exploit the Service without written authorization from Discreta

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Emergency Contacts

You are solely responsible for obtaining the consent of each person you add as an emergency contact before adding them to your account. By adding a contact, you represent that:

• That person has agreed to receive SMS alerts from Discreta on your behalf
• The phone number you have provided is accurate and belongs to that person

Discreta is not responsible for alerts that fail to reach contacts due to incorrect phone numbers, carrier issues, or contacts' device settings.

8. Intellectual Property

All content, branding, software, and materials associated with Discreta - including the App, website, logo, and documentation - are the property of Discreta and are protected by applicable intellectual property laws in Canada and the United States.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal safety purposes in accordance with these Terms. This license does not include any right to copy, modify, distribute, or create derivative works from any Discreta materials.

9. Termination

You may cancel your subscription at any time after the 3-month minimum period by contacting us. We may suspend or terminate your account immediately and without notice if:

• You breach any provision of these Terms
• We are required to do so by law
• We determine, in our sole discretion, that continued access poses a risk to other users or to the integrity of the Service

Upon termination, your right to use the App will cease. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, and 10) will remain in effect.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts located in Montreal, Quebec, Canada.

If you are a U.S.-based user, you acknowledge that you are contracting with a Canadian company and consent to the jurisdiction and governing law set out above.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date and notify you via the App or email at least 14 days before changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
